{"id":89425,"date":"2022-12-18T06:55:36","date_gmt":"2022-12-18T01:25:36","guid":{"rendered":"https:\/\/www.dailypunjabtimes.com\/english\/?p=89425"},"modified":"2022-12-18T06:55:39","modified_gmt":"2022-12-18T01:25:39","slug":"dominant-groups-morality-creeps-into-lawmaking-cji","status":"publish","type":"post","link":"https:\/\/www.dailypunjabtimes.com\/english\/dominant-groups-morality-creeps-into-lawmaking-cji\/","title":{"rendered":"Dominant groups\u2019 morality creeps into lawmaking: CJI"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">New Delhi: People\u2019s confidence for the protection of liberties rests in the judiciary, Chief Justice of India Dhananjaya Y Chandrachud asserted on Saturday even as he rued how \u201cadequate morality\u201d of dominant groups creep into lawmaking to perpetuate biases against weaker and vulnerable sections of the society.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Delivering the Ashok Desai Memorial Lecture in Mumbai, the CJI defined \u201cadequate morality\u201d as the morality of men, the upper castes, and able-bodied persons. Desai was a former Attorney General and a senior advocate who passed away in 2020.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Chandrachud\u00a0was speaking on the topic, \u201cLaw and Morality: The Bounds and Reaches\u201d, when he highlighted the need to adopt the progressive values enshrined in the Constitution and enforcement of constitutional morality to counter the impulses of adequate morality or public morality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cEven after the framing of the Constitution, the law has been imposing \u2018adequate morality\u2019, that is, the morality of the dominant community. In our parliamentary system of democracy, laws are passed by the vote of majority. Therefore, the discourse around public morality often finds its way into the law enacted by the majority,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The CJI\u2019s statements come at a time when several states, including Uttar Pradesh and Karnataka, have come up with stringent laws against religious conversions for marriages \u2014 often described as \u201clove jihad\u201d legislation. These laws have been criticised by several groups and experts, and also challenged before the constitutional courts on the grounds of being an outcome of an authoritarian politics emanating from majoritarianism and religious bias.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Saturday, lamenting that differential moral concerns or biases often creep into law, the CJI flagged that such biases reflect categorical preference for and against certain people within our community.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Chandrachud illustrated his statement by citing ban on books, plays and restrictions on dance bars in Maharashtra\u2019s establishments that were not three stars or above.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>New Delhi: People\u2019s confidence for the protection of liberties rests in the judiciary, Chief Justice of India Dhananjaya Y Chandrachud asserted on Saturday even as he rued how \u201cadequate morality\u201d of dominant groups creep into lawmaking to perpetuate biases against weaker and vulnerable sections of the society.
