As part of the controversy over the dual constitution of the SAD, the Supreme Court stayed proceedings before a Hoshiarpur court on Tuesday in the alleged case of forgery and cheating filed against Sukhbir Singh Badal, Parkash Singh Badal, and Daljit Singh Cheema.<\/p>\n\n\n\n
An Additional Chief Judicial Magistrate, Hoshiarpur, was issued a notice and stayed proceedings by a Bench made up of Justices S Abdul Nazeer and V Ramasubramanian.<\/p>\n\n\n\n
The Additional Chief Judicial Magistrate of Hoshiarpur received a criminal complaint in 2009 from Balwant Singh Khera accusing SAD of submitting two different constitutions to the Gurdwara Election Commission (GEC) and the Election Commission of India (ECI) to be recognized as a political party.<\/p>\n\n\n\n
In their appeal, Sukhbir Singh Badal, Prakash Singh Badal and Cheema challenged the Punjab and Haryana High Court’s decision rejecting their request to quash the complaint.<\/p>\n\n\n\n
For Sukhbir, senior advocate RS Cheema appeared and for Parkash Singh Badal, senior advocate KV Viswanathan appeared assisted by attorneys from Karanjawala & Co. Cheema was represented by advocate Sandeep Kapur. Karanjawala & Co. filed the petitions.<\/p>\n\n\n\n
A political outfit contesting elections for a gurdwara committee does not mean it is not secular, it was argued before the court that being religious does not contradict secular principles. It was argued that the criminal case filed before the ECI and GEC with allegations of forgery and cheating over the party constitution had no basis.<\/p>\n\n\n\n
