Move Jagtar Singh Hawara to Chandigarh if Delhi doesn’t have any cases pending

If no other case against Jagtar Singh Hawara is pending before the courts in Delhi, the court of Additional Sessions Judge, Chandigarh, has directed the jail authorities to move him to Chandigarh so that the trial may proceed smoothly.

A life sentence is being served for Hawara’s assassination of former Punjab Chief Minister Beant Singh in Tihar Jail in Delhi. When the authorities failed to produce Hawara in person or through video-conferencing, the court ruled that the accused may be called in person by the prosecutor, defence counsel, and AS Chahal.

On October 4, the Chandigarh court issued a production warrant against Hawara in two cases filed against him in 2005.

Considering that the arguments on the charges are to be heard and the accused must appear in person on December 17, a warrant be issued to the jail directing them to produce the accused. In the event that no other case against the accused is pending before Delhi courts, the jail authorities are directed to transfer him to Chandigarh so the trial can proceed smoothly.”

At the Sector 36 and Sector 17 police stations in Chandigarh, two FIRs were filed against Hawara. There were several FIRs registered under the IPC Sections 121, 121 A, 122, 153, and 120 B, the Arms Act Sections 25, 54 and 59, and the Explosive Substances Act Sections 4, 5 and 6. Cases were filed on allegations that the accused planned to wage war against the government.
